THESE TERMS AND CONDITIONS WERE LAST REVISED ON 2011/11/14 AND CONTAIN TERMS WHICH (A) LIMIT THE LIABILITY OF LexisNexis (Pty) Ltd; (B) CONSTITUTE AN ASSUMPTION OF RISK OR LIABILITY ON YOUR PART; AND (C) IMPOSE AN OBLIGATION ON YOU TO INDEMNIFY LexisNexis (Pty) Ltd.

AS SUCH YOU ARE ADVISED TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING TO MAKE USE OF THE SERVICE.

1. LexisNexis (Pty) Ltd ("LexisNexis (Pty) Ltd") provides you with the use of this dashboard ("the service").
2. By selecting "I accept" below and proceeding to make use of the service (a) you represent to LexisNexis (Pty) Ltd that you have all necessary authority to bind the organisation that you represent to the terms and conditions ("the terms") set out below and (b) you indicate acceptance that both you and the organisation that you represent (referred to collectively further along as "you"), are bound by the terms set out below.
3. These terms supersede any terms and conditions previously accepted by you in relation to the use of the service.
4. You acknowledge and agree that in the context of the service LexisNexis (Pty) Ltd acts solely as a message carrier and enabler and has no responsibility or liability for the content of messages conveyed by the service.
5. You acknowledge and agree that while the service utilises generally accepted standards of public-private key cryptology to ensure the security of messages exchanged across the service and of data retained within the service, LexisNexis (Pty) Ltd has no liability to provide any other security in relation to messages exchanged using the service or data retained within the service and that LexisNexis (Pty) Ltd has no liability whatever to you in the event of any messages exchanged across the service or any data retained within the service coming into the possession of or being read by, unauthorised third parties.
6. You acknowledge and agree that by using the service certain information relating to transactions with which you are concerned (including the details of the properties with which you are concerned) will become available to other users of the service. You further acknowledge and agree that neither LexisNexis (Pty) Ltd nor the service is capable of limiting or controlling how such information may be used by other users.
7. You acknowledge and agree that you bear the sole and absolute responsibility for determining and verifying the identity and authenticity of any other user of the service with whom you interact in relation to any property transaction and that LexisNexis (Pty) Ltd has no responsibility or obligation whatever to determine or ensure the authenticity of any other user or purported user of the service.
8. You acknowledge and agree that whereas access to the service is made possible by knowledge-based passwords, it is your sole and absolute responsibility to ensure the security and safekeeping of such passwords and LexisNexis (Pty) Ltd shall have no responsibility or liability whatsoever to you should any unauthorised party obtain access to the service by virtue of any password becoming known to them other than by virtue of LexisNexis (Pty) Ltd failing to adequately secure the service.
9. You acknowledge and agree that by selecting "I accept" below and proceeding to make use of the service you waive all claims of whatever nature and however arising that you may have against LexisNexis (Pty) Ltd arising out of or in connection with your use of the service. Furthermore, you indemnify and hold LexisNexis (Pty) Ltd harmless in respect of all claims of whatever nature and however arising that may be brought against LexisNexis (Pty) Ltd in connection with the use of the service by any third party for whom you act or for the benefit of whom you utilise the service.
10. You acknowledge and agree that certain of the information communicated through or retained within the service may, subject to the terms of all applicable law, be collated and processed by LexisNexis (Pty) Ltd for commercial purposes.
11. You acknowledge and agree that LexisNexis (Pty) Ltd may disclose all and any information provided by you during the course of using the service in circumstances where either (a) LexisNexis (Pty) Ltd is obliged to do so by compulsion of law; or (b) where it is necessary or desirable for LexisNexis (Pty) Ltd to do so in circumstances where it is alleged that any fraudulent or unlawful activity has occurred by means of or in relation to, the service or any information obtained by means of the service ; or (c) where it is necessary or desirable for LexisNexis (Pty) Ltd to do so in connection with the investigation of any inappropriate use of the service by any user; or (d) where it is necessary or desirable for LexisNexis (Pty) Ltd to do so for the purposes of enforcing any of its rights under these terms.
12. You undertake to report to LexisNexis (Pty) Ltd all violations of these terms or inappropriate use of the service that may come to your attention.
